Roadside Memorial

There is currently no specific legislation, rules, policy, law or guidance on if Roadside Memorials are allowed in the state of Kentucky KY or not.  We take this as if you were to put up a roadside memorial on a Right Of Way road in the state of Kentucky that there is a chance that it can be taken down by Kentucky’s Department Of Transportation if your Roadside Memorial is causing safety issues or concerns.

If your Kentucky roadside memorial is not causing safety issues or problems, chances are that it will be left alone.  We also suggest that you build it away from any grass cutting that may be done by the state, meaning, set up your Kentucky KY Roadside Memorial back a bit from the actual road.  Kentucky is not the only state without any specific roadside memorial policy or laws, but it does make it clear that no private signage is allowed on Kentucky right of way unless they are not put up in some sort of official state regulated sign program.

Maintenance crews may do their best to avoid the Kentucky roadside memorials, but if they are in the way and are causing an issue with the roadside maintenance they may be removed and or just simply set back a bit more from their actual location.  If the Kentucky Roadside Memorial is removed completely they are taken to the nearest State Shed DOT location and held for retrieval or or contact is made with the Kentucky roadside memorial family.  If after a certain length of time the family cannot be located and the Kentucky Roadside Memorial is not picked up, it will be disposed of.  The State of Kentucky assumes no responsibility with illegal Roadside Memorials that are taken down or damaged.

Our son passed away on 5/29/22. He had a car accident in front of menards on preston highway. We would like to put up a memorial there but don’t know how and where we need to put it at.
